Please read carefully before booking your trip with H&H Travel Group
PLEASE READ CAREFULLY BEFORE BOOKING YOUR TRIP WITH HOTELES & HOGARES LTD / PARTNERS
The following terms and conditions apply to any trip booked with HOTELES & HOGARES LTD/ STATED PARTNERS. By booking a trip with HOTELES & HOGARES LTD you (hereinafter referred to as, “you” “your” or “traveler”) acknowledge that you (i) are 18 years of age or older, (ii) understand and accept these terms and conditions (the “Terms and Conditions”) and (iii) are entering into a contractual relationship with HOTELES & HOGARES LTD.
PRICE POLICY; TRIP DEPOSIT; INVOICING; FULL PAYMENTS
All trip prices are as stated on The HOTELES & HOGARES LTD website at the time of booking and do not include international airfare. Trips are priced per person, based on shared occupancy. Single rooms may be available at an additional cost and the prices will be listed where applicable. Prior to booking, prices are subject to change without notice. If you are using our payment plan option, you must submit a non-refundable, non-transferable, per-person deposit at the time of booking to reserve your space. The balance is to be settled directly with HOTELES & HOGARES LTD.
Making any deposit payments to HOTELES &HOGARES LTD and partners indicates that you have read and accepted the Terms and Conditions. Once your deposit has been received and processed by HOTELES & HOGARES LTD or our partner’s website you will receive confirmation of your booking by email. HOTELES & HOGARES LTD may send you an additional email with the payment terms and details of the trip. Each traveler is responsible for verifying the information and notifying HOTELES & HOGARES LTD of any discrepancies or errors. If there is an error HOTELES & HOGARES LTD will send a revised invoice to reflect the correct pricing. HOTELES & HOGARES LTD may cancel your booking if the final payment is not received by the due date. Final payment is usually due between 3 weeks before the start of the trip.
PAYMENT TERMS
All payment balances for tours curated by us should be settled directly with HOTELES & HOGARES LTD. Payment of the balance should be complete no later than 21 days before the trip start date. If full payment is not received HOTELES & HOGARES LTD may cancel the booking and retain the amount paid as a cancellation penalty fee at HOTELES & HOGARES LTD sole discretion.
INCOMPLETE/LATE PAYMENTS/ABANDONED BOOKINGS
Failure to make full payment by the agreed date will result in a cancellation and full loss of your investment.
All abandoned payments are processed as canceled bookings. You will not be eligible for any refunds or trip transfers for incomplete/abandoned bookings.
HOTELES & HOGARES LTD will not be responsible for any transactional fees/charges incurred from third-party payment services.
HOTELES & HOGARES LTD reserves the right to make changes to any and all aspects of the trip (which may include without limitation changes to the types and/or timing of activities available during the trip, items and/or services included with the trip, accommodation, the itinerary, and/or the nature of the trip) if, in HOTELES & HOGARES LTD sole discretion, HOTELES & HOGARES LTD deems it necessary to do so due to conditions that may be hazardous, dangerous, or otherwise adverse or threatening, if an act or omission of a third party prevents any such aspects of the trip or any portion of the trip, or for any other reason considered commercially necessary by HOTELES & HOGARES LTD. You will not be eligible for any refunds of any amounts based on any such changes by HOTELES & HOGARES LTD.
REFUNDS/ TRIP TRANSFERS
. Bookings are refundable for 24 hours only. Once this time has lapsed your booking can only be transferred to another trip that we are hosting. A transfer fee of $100/ per person will apply. HOTELES & HOGARES LTD will not issue refunds to any client for any reason. HOTELES & HOGARES LTD will only issue refunds if a trip is cancelled by HOTELES & HOGARES LTD. In such a case the client will receive a full refund excluding the initial trip deposit amount of $500 which applies to all our tours.
CANCELLATIONS BY US
HOTELES & HOGARES LTD reserves the right to cancel your reservation if your total payment is not received on or before the payment due date and you will not be eligible for any refunds of any amounts. HOTELES & HOGARES LTD reserves the right to cancel the trip prior to the Departure date in the event an insufficient number of registrants are confirmed for the trip or for any other commercial reason in HOTELES & HOGARES LTD sole discretion and, in such an event, you will receive a full refund of the amount you remitted to HOTELES & HOGARES LTD excluding the deposit. With that said in no event will HOTELES & HOGARES LTD issue any refunds for postponed trips or travel credits for incomplete payments. HOTELES & HOGARES LTD will not be responsible for any other amounts, including preparation costs, airfare, travel documents, Travel insurance or any other Losses or claimed damages. HOTELES & HOGARES LTD may cancel or reschedule a trip for any reason. Cancelled trips by the traveler will result in the complete loss of your entire trip investment due to non-refundable pre-paid bookings for accommodations and tours. HOTELES & HOGARES LTD may, but will have no obligation to reschedule cancelled trips however HOTELES & HOGARES LTD may postpone and reschedule trips that are disrupted by unforeseen circumstances such as worldly issues, natural disasters and pandemics. HOTELES & HOGARES LTD may also choose to reschedule a trip for any other reasons stated or unstated. HOTELES & HOGARES LTD will not be responsible for any additional costs or any fees incurred by you due to the cancellation or rescheduling of a trip. It is therefore your responsibility to purchase travel insurance that covers trip cancellation costs. The cost of airline tickets or other travel arrangements, not made by HOTELES & HOGARES LTD will be the sole responsibility of the traveler. For this reason, HOTELES & HOGARES LTD advises that every traveller gets travel insurance which covers trip cancelation when booking a trip with us.
CANCELLATIONS BY THE CLIENT
All cancellations by you must be in writing and emailed to (info@hoteleshogares.com) or the contact email address specified on the partner website. A full refund, not including a deposit, will be issued if your cancellation request is received by HOTELES & HOGARES LTD within 24 hours after booking a trip. The refund will be reimbursed to you within 21 business days. If cancellation takes place any later you forfeit the right to a refund of any amounts. All payments are non-refundable after 24 hours.
In the event of any change or cancellation, you acknowledge that you will have no right to refund of the total payment (whether in whole or in part) and no right to claim compensation for any Liabilities incurred and/or sustained by virtue of any change or cancellation.
TRAVEL CREDITS
Travel credits may be issued in the event that a traveller is unable to attend new dates given by HOTELES & HOGARES LTD for postponed trips ONLY. All amounts paid will become transferable entirely dependent on the time frame between cancellation or postponement and the actual trip date. Terms may apply such as limits to and restrictions to which trips you may transfer your investment towards. No amounts will be refundable in part or full. Travel credits allow for more flexibility and are valid for 6 months from your initial trip postponement date. If your travel credit is not used within the 6-month period the credit will become invalid.
All travel credits require approval and confirmation by HOTELES & HOGARES LTD. Travel credits will only be issued in the event of a trip cancellation/ Postponement due to Covid-19-related restrictions. In no way will travel credits be issued for any other reasons.
Travel credits will not be issued to clients with incomplete payments. Or clients who cancel their trip for any reasons unknown to HOTELES & HOGARES LTD. For a client to be eligible for a travel credit the full amount of the trip cost must be paid in its entirety.
CLIENT AGREEMENT
By booking any trip by us you agree that you are over the age of eighteen (18) and are healthy, in good physical and mental health, and are at a level appropriate to participate in, and are fully capable of participating in, the trip. You further represent that you do not suffer from any medical conditions or disabilities that may restrict, limit, prevent, or preclude your participation in the trip, including any Physical Activities. You have consulted with your physician and your physician has authorized you to participate in the trip, including any Physical Activities. You will discuss and address any questions or concerns you may have about your physical or mental health with the appropriate health care professional prior to the Departure Date. Documentation from your physician confirming your clearance to participate in the trip can be provided upon request. If, at any time, you have any doubts about your physical condition or fitness to participate in any aspect of the trip, you will cease participation in the same and seek appropriate medical attention. YOU ARE HEREBY ADVISED THAT THE TRIP MAY TAKE PLACE IN REMOTE AREAS WHERE THERE IS LITTLE OR NO ACCESS TO TRADITIONAL MEDICAL SERVICES OR HOSPITAL FACILITIES FOR SERIOUS HEALTH ISSUES (OR YOU’RE PARTICULAR HEALTH ISSUES). YOU ARE FURTHER ADVISED THAT ANY MEDICAL OR EVACUATION EXPENSES WILL BE YOUR SOLE RESPONSIBILITY. As a result, we strongly encourage you to purchase travel insurance with appropriate coverage for your needs. We reserve the right in our sole discretion to refuse your participation in the trip, Physical Activities, and/or any other activities, due to medical, fitness, or other grounds. HOTELES & HOGARES LTD also reserves the right to deny participation in the trip or any related activities at any time to individuals demonstrating behavior that may result in injury to themselves or others.
You understand that serious accidents may occur during Physical Activities and that participants can sustain fatal and/or serious personal injury. As stated above, the trip may take place in a remote location where there is little or no access to traditional medical services or hospital facilities for serious and/or particular health issues. You may also be visiting places where the political, cultural, and geographical attributes of the location present risks and physical challenges that are greater than those present in your country of residence. It is your own responsibility to familiarize yourself with all possible relevant travel information in connection with your participation in the trip. Understanding and in full consideration of the foregoing, you agree to solely and exclusively assume full and complete responsibility for and the risks inherent in travel and engaging in Physical Activity which may include injury, death, property damage, and/or any other kind of Liability, whether foreseen or unforeseen, which may occur during your participation in the trip. You acknowledge that your decision to participate in the trip is made in full consideration of the foregoing information and that you solely and exclusively assume the risks involved with participating in the trip. IN NO EVENT WILL HOTELES & HOGARES LTD BE LIABLE FOR ANY LIABILITIES ARISING FROM OR IN CONNECTION WITH YOUR PARTICIPATION IN THE TRIP.
LIABILITY
In the event you are injured while participating in the trip, you agree to assume all financial obligations for any and all medical costs you incur. You acknowledge and agree that IN NO EVENT SHALL HOTELES & HOGARES LTD AND OUR MARKETING PARTNERS/OR ANY COMPANY PARTY BE LIABLE OR RESPONSIBLE FOR ANY LOSSES OR LIABILITIES ARISING OUT OF YOUR PARTICIPATION IN THE TRIP.
In consideration for participating in the trip, YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR AND HEREBY RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, AND COVENANT NOT TO SUE HOTELES & HOGARES LTD, ITS OFFICERS, MEMBERS, AGENTS, CONTRACTORS, EMPLOYEES, VOLUNTEERS, GUIDES, FOUNDER, MARKETING PARTNERS AND OTHER REPRESENTATIVES (each a “company party” and collectively, the “company parties”) FOR ANY AND ALL CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, AND/OR LOSSES (including but not limited to any exemplary, direct, indirect, incidental, special, consequential, punitive, or other damages, medical expenses, lost wages/income, loss of services, lost profits, property damage, pain, illness, and death) (collectively “liabilities”) WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO YOUR TRAVEL TO AND/OR PARTICIPATION IN THE TRIP AND/OR ANY ACTIVITIES CONDUCTED IN CONNECTION THEREWITH, REGARDLESS OF WHETHER SUCH LIABILITIES ARE CAUSED BY THE NEGLIGENCE OF ANY COMPANY PARTY OR OTHERWISE, AND REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ANY COMPANY PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITIES, TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW. You have been advised and urged to obtain travel insurance to cover against Liabilities resulting from trip cancellation or interruption, weather, natural disaster, strike, illness, job reasons, accident, sickness, evacuation, pre-existing medical conditions, baggage delay, loss, theft, and other Liabilities associated with travel and your participation in the trip. You acknowledge that whether or not you elect to purchase or not purchase travel insurance, you will not look to any of the HOTELES & HOGARES LTD TEAM /PARTNERS for reimbursement for any Liabilities suffered or occurring during your travel and/or participation in the trip.
Gratuities are included for services during certain portions of the trip. This includes gratuities for wait staff, included meals and hospitality staff at accommodations for nights purchased through HOTELES & HOGARES LTD. Gratuities for your tour director, local hosts, local guides and driver are not included in the trip price (unless otherwise noted in pricing details) and are discretionary.
The following charges are not included in the trip price unless otherwise noted: airfare to and from the start of your trip; airline baggage fees including checked and/or excess baggage fees; passports; visas and vaccinations; tips to your tour director, local host, driver, local guides, rest room attendants; gratuities on ferries, trains; laundry; telephone; minibar; alcohol, beverages, and food outside of the contracted HOTELES & HOGARES LTD meals as presented at accommodations venues or restaurants (these extra items will be billed to you before leaving the accommodation or restaurant); optional excursions; porterage at airports and train stations; travel insurance; and all other items of a personal nature.
AIRFAIR
Travelers must purchase their own return airline tickets to the travel destination. HOTELES & HOGARES LTD will not arrange air transportation and shall not be responsible or liable for a traveler’s airfare, airline ticket, or air travel arrangements. All issues with your air travel shall be resolved with the respective airline on which you are ticketed. In the event, the airline cancels, reschedules, or delays a flight for any reason or you miss your departure flight or connection, no refunds will be provided by HOTELES & HOGARES LTD for missed portions of the trip. You are fully responsible for any additional expenses you may incur prior to joining the trip if you miss your departure flight or connecting flight. HOTELES & HOGARES LTD recommends all travelers purchase travel insurance with provisions to cover unforeseen and unexpected expenses.
HOTELES & HOGARES LTD recommend traveler’s to purchase travel insurance for their HOTELES & HOGARES LTD trip. The insurance should cover the cost of trip cancellations, flight delays and cancellations, loss of employment, and accidents and illness suffered by you that would prevent you from traveling on your booked trip or that may occur during the trip. You should consider purchasing additional coverage to cover any money you may have spent prior to your scheduled trip departure. Travelers can submit documentation evidencing their purchase of traveler’s insurance to HOTELES & HOGARES LTD upon request. HOTELES & HOGARES LTD is not responsible for any losses you incur and/or sustain, or mentioned expenses if you do not purchase travel insurance.
All tour directors, local hosts and local guides utilized by HOTELES & HOGARES LTD speak English. Travelers should be able to speak, read and understand English.
In the event HOTELES & HOGARES LTD believes that a traveler may interfere with other traveler’s enjoyment of the trip, HOTELES & HOGARES LTD may, in its sole discretion, refuse to allow the traveler to commence the trip or remove a traveler from the trip. Travelers who (i) are considered a danger to themselves or others or (ii) have engaged in or are threatening to engage in behavior that may adversely affect the safety, security, comfort, enjoyment, or well-being of other travelers or HOTELES & HOGARES LTD representatives (including, but not limited to, behavior that is disruptive, verbally abusive, physically abusive, obnoxious, harassing, discriminatory, or obscene) or (iii) have failed or refused to following HOTELES & HOGARES LTD directives, recommendations, instructions, policies, or procedures, may be removed from the trip. In the event HOTELES & HOGARES LTD refuses participation in an activity or removes a traveler, HOTELES & HOGARES LTD may leave the traveler at any destination and shall not be liable or responsible for accommodations, transportation, meals, medical care, or any other expenses incurred by the traveler after refusal or removal from the trip. HOTELES & HOGARES LTD will not refund any portion of the price paid by any traveler who is refused or removed and HOTELES & HOGARES LTD will be entitled to recover from the traveler any costs or expenses incurred by HOTELES & HOGARES LTD in removing or refusing the traveler.
HOTELES & HOGARES LTD requires travelers to be 18 years of age or older to book a trip and travel alone. Persons under the age of 18 must have an adult (over the age of 21) accompany them on the trip and share accommodations.
International travel requires a passport. You must verify all requirements and obtain a passport and all necessary visas for your travel destination, including all health requirements if any. If you are refused entry into any country for failing to meet the entry and exit requirements, HOTELES & HOGARES LTD will not be liable. All travelers must consult with their appropriate consulates to determine if any visas or other documents are needed for entry. For more information on passport and visa requirements.
ACCOMMODATIONS
HOTELES &HOGARES LTD uses various accommodations such as hotels, Airbnb villas, and bed-and-breakfasts to house travelers during a trip. Each trip will vary in terms of the accommodations used. Shared room accommodations, with twin beds, will be provided (double). Single room accommodations may be available at an additional charge and must be requested at the time of booking. Room and bed preferences are not guaranteed. Check-in times vary worldwide. HOTELES & HOGARES LTD cannot control or guarantee check-in times.
If a situation arises during the trip, please advise a HOTELES & HOGARES LTD representative of your complaint or claims as soon as possible. All complaints involving HOTELES & HOGARES LTD services or the services of its third-party suppliers, and marketers must be relayed to HOTELES & HOGARES LTD within 30 days after completion of the trip. If not, you will forfeit any compensation or other resolution that may have been due to you.
Certain planned activities during the trip may be unavailable if such activities fall on dates that are designated local or national holidays. In the event a planned activity is unavailable, if possible, HOTELES & HOGARES LTD will offer an alternative activity. No refund or discount will be given to travelers for events that are cancelled due to local customs.
HOTELES & HOGARES LTD endeavors to
provide a safe environment and experience for its travelers but cannot protect or guard travelers from certain risk and dangers when traveling abroad. During a trip travelers may be faced with forces of nature; political unrest; acts of lawlessness or terrorism; accidents or illnesses or other situations that may endanger the life of the traveler. HOTELES & HOGARES LTD will not be responsible for any risks and dangers that may arise and by booking a trip with HOTELES & HOGARES LTD you agree not to hold HOTELES & HOGARES LTD and partners liable for any harm suffered by you during the trip. You agree to hold HOTELES & HOGARES LTD harmless regarding any provision of medical care or the adequacy of any care rendered. You must ensure that you are informed and aware of the applicable health requirements and recommended precautions relevant to the trip and that you carry all necessary vaccination documents, personal health information or personal medication. You run the risk of being denied entry into a country if you fail to present the required vaccination documentation.
Photographs appearing on the HOTELES & HOGARES LTD and Partners website are used solely as a representation or similar depiction of the possible facilities and attractions. All travellers should not rely on those depictions due to camera angles and routes that may e taken on the trip. Actual facilities and attractions will vary. On some trips, HOTELES & HOGARES LTD may hire a photographer to take pictures of the travellers, activities, and attractions. By booking a trip with HOTELES & HOGARES LTD/ partners, you agree to grant HOTELES & HOGARES LTD permission to use photos of you taken during the trip by the HOTELES & HOGARES LTD photographer on our website and social media platforms for marketing purposes only. HOTELES & HOGARES LTD may, in its sole discretion, make the pictures available to travellers as part of the trip or as an additional cost. In the event you upload your photos to the HOTELES & HOGARES LTD/ Partners website, any upload grants a perpetual license to HOTELES & HOGARES LTD to use your photos for marketing purposes.
Optional excursions, outside of the planned HOTELES & HOGARES LTD trip activities may be available for booking through local operators or other third parties. These parties are entirely independent of HOTELES & HOGARES LTD and do not form any part of the HOTELES & HOGARES LTD trip. Any optional excursion you book will not be governed by these Terms and Conditions. In booking with a third party/local operator, you will be entering into a contract with said organizer or operator and will be subject to their terms and conditions, which may include limitations of liability or exclusions. HOTELES & HOGARES LTD shall not be liable for any optional excursions or for any acts or omissions of the third-party/local operator, its employees or agents or any other person connected therewith, even where HOTELES & HOGARES LTD advertises, suggests or assists with booking an optional excursion with the third-party or local operator. Any advice or assistance on or with any optional excursions provided by any local representative does not mean or imply that the option is sold, supervised, or controlled by HOTELES & HOGARES LTD, or that any such advice or assistance is given on behalf of HOTELES & HOGARES LTD HOTELES & HOGARES LTD advises travelers to check with the operator of any optional excursion for the applicable terms and conditions before booking.
Wi-Fi connectivity may or may not be available during the trip. If available, it may be delayed, slowed, or otherwise interrupted. HOTELES & HOGARES LTD has no obligation to provide travelers with Wi-Fi connectivity during travel in remote areas.
By using HOTELES & HOGARES LTD website and booking a trip with HOTELES & HOGARES LTD/Partners, you consent to HOTELES & HOGARES LTD use of your personal information. You acknowledge and agree that by purchasing a trip with HOTELES & HOGARES LTD, you consent to HOTELES & HOGARES LTD transmitting your personal information to our third-party suppliers, as necessary. You acknowledge that you have reviewed and agreed with the HOTELES & HOGARES LTD privacy policy.
HOTELES & HOGARES LTD is an independent limited liability company acting as an intermediary to provide a trip comprised of services offered by third-party suppliers. Third-party suppliers providing trip services are not agents, employees, servants, or joint venturers of HOTELES & HOGARES LTD. HOTELES & HOGARES LTD has independent contracts with each of the suppliers for the services. All trip services provided by third-parties are subject to the terms and conditions specified in the third party supplier documents and to the laws of the countries in which the services are supplied. The third party supplier terms and conditions are available to you upon request. You agree that neither HOTELES & HOGARES LTD nor its representative shall be liable for any damage, loss (including personal injury, death, and property loss), or expense occasioned by any act or omission of any supplier providing services. After departure, if the services included in the trip cannot be supplied or there are changes in an itinerary for reasons beyond the control of HOTELES & HOGARES LTD, depending on the circumstance, HOTELES & HOGARES LTD will take reasonable action to arrange for the provision of comparable services. Any resulting additional expense will be the responsibility of travelers.
To the extent permitted by law, neither HOTELES & HOGARES LTD nor any of its related companies, directors, employees or agents accept any liability in contract, tort or otherwise for any claim, injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of another traveler or third party providers over whom HOTELES & HOGARES LTD has no direct control, by force major or by any other event which is beyond HOTELES & HOGARES LTD control. Any limitation of responsibility stated for HOTELES & HOGARES LTD in these Terms and Conditions applies and extends to its related companies, directors, officers and agents. This limitation of liability provision does not make HOTELES & HOGARES LTD responsible for any costs and fees that are specifically stated as being your responsibility. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of HOTELES & HOGARES LTD under applicable law.
LAW & JURISDICTION
Unless otherwise precluded by law, disputes or claims must be filed within three months following completion of the trip. This agreement shall be governed by Kenya, and any dispute, mediation, or arbitration pertaining to this agreement must take place and may be brought only in courts in Kenya. Mediation shall be the first form of resolution for any dispute between you and HOTELES & HOGARES LTD.
The Terms and Conditions may only be amended, modified, or waived by an authorized representative of HOTELES & HOGARES LTD. Any such modification, amendment, or waiver must be in writing. The Terms and Conditions are subject to change. HOTELES & HOGARES LTD advises you to check the HOTELES & HOGARES LTD /PARTNERS website for the latest version of the Terms and Conditions prior to booking your trip.
